Terms and Conditions for CreativeUP
These Terms and Conditions (“Terms”) govern the digital marketing services provided by CreativeUP (“we,” “us,” or “our”). By engaging our services, you agree to these Terms. Our services are primarily tailored for customers in the United States and Europe, though we operate globally.
1. Marketing Services & Platform Access
CreativeUP provides access to a specialized, white-labeled marketing and automation platform designed to streamline your business operations.
- Platform Integration: To fulfill our services, we will input your business information and link your existing website and social media accounts (e.g., Facebook, Instagram, LinkedIn) with our management dashboard.
- Service Scope: Our services include digital automation, lead management, and marketing campaign execution as defined in your specific service plan.
2. Client Data & Account Access
To provide our marketing automation and management services, we collect information from:
- Contact Information: We may collect your name, email address, phone number, and mailing address when you submit forms, book appointements or request information.
- Communications Data: If you opt-in, we collect your messaging preference and maintain records of consent and opt-out activity related to SMS and email communications.
- Usage and Device Information: We use cookies, pixels, and analytics tools to collect information about how you use our website, email addresses and interaction data.
- Appointement and Service Data: If you schedule consultations or use our services, we collect details associated with those interactions.
- Direct Interaction: Information you provide when signing up, such as your name, business email, and billing details.
- Integrated Accounts: Information accessed when you link your business website and social media profiles (e.g., Meta, LinkedIn, Google) to our service platform.
- Third-Party Data: Information about your customers or leads that you manually upload or automatically import into our system for marketing purposes.
- SMS Program and Messaging use cases: We use these information for the clients according to the option they have chosen such as the promotional, informational, notification, alerts, appointments date etc.
- Opt-out option: To stop receiving messages from CreativeUP B.I. there will be the option of ”reply STOP to any text message”
- Message and data rates may apply: Check with your carrier for details.
- Carriers are not liable for delayed or undelivered messages.
- You must be 18 years or older to use this SMS service.
By engaging CreativeUP, you grant us the following authorities:
- Information Input: You authorize us to manage and input your business data, customer leads, and creative assets into our management systems.
- Integration Permissions: You agree to provide the necessary administrative access to your social media profiles and web hosting providers to ensure seamless technical integration.
- Confidentiality: All client-provided data is treated as strictly confidential and used solely for the execution of your marketing strategy.
3. International Compliance
As we serve clients in the United States and Europe, you agree to the following:
- Data Protection: You are responsible for ensuring that any customer data provided to us or collected through our platform complies with the GDPR (Europe) and the CCPA/TCPA (United States).
- Lawful Marketing: You must ensure that all email and SMS marketing conducted through our systems adheres to the CAN-SPAM Act and other local regulations.
4. Fees and Payment
- Billing: Service fees and platform subscriptions are billed according to your selected plan.
- Suspension of Service: We reserve the right to pause marketing activities and restrict platform access if payments are not received by the due date.
5. Intellectual Property
- Deliverables: Upon full payment, you retain rights to the marketing content and branding assets created specifically for your business.
- System Assets: CreativeUP retains ownership of all proprietary automation workflows, custom “snapshots,” and system configurations developed by our team.
6. Limitation of Liability
CreativeUP acts as a service provider and facilitator. We are not liable for:
- Interruptions caused by third-party social media APIs or external web hosting.
- Any loss of data or revenue resulting from the use of the marketing platform.
- Account restrictions imposed by social media networks due to your content or business practices.
7. Governing Law & Jurisdiction
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Republic of Kosovo. Any legal actions or proceedings shall be brought exclusively in the competent courts of the Republic of Kosovo.
8. Termination
- Cancellation: You may cancel your subscription or service agreement by providing written notice 30 days prior to the next billing cycle.
- Termination by Us: We reserve the right to terminate access if these Terms are violated or if your activities compromise our technical infrastructure.
